Terms of service
Effective date: 22 October 2026
These Terms of Service apply to your use of the Ridewave Bikes website and your purchase of products or services from Healthgenic Pty Ltd trading as Ridewave Bikes ("Ridewave", "we", "us" or "our"). By using our website or placing an order, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Using our website
You may use our website for personal, lawful shopping and information purposes. You must not misuse the website, interfere with its security or operation, attempt unauthorised access, introduce malicious code, scrape content or data without permission, or use the website in a way that infringes another person's rights or breaches the law.
If you create an account, you are responsible for keeping your login details secure and for information submitted through your account. Please contact us promptly if you believe your account has been accessed without permission.
If you are under 18, you may use the website only with the involvement and approval of a parent or legal guardian. We may refuse or cancel an order where we reasonably believe the purchaser does not have authority to enter into the transaction.
Product information and availability
We aim to make product descriptions, specifications, images, pricing and availability information accurate. Images are illustrative and colours may vary between screens. Minor product or packaging updates may occur, provided they do not materially reduce the product's safety, purpose or advertised core performance. If a material change affects your order, we will contact you before dispatch where practicable.
Electric-bike and electric-trike range figures are estimates only. Actual range can vary with battery age and condition, rider and cargo weight, terrain, weather, temperature, tyre pressure, assist level, speed and riding style.
Products may be unavailable, discontinued or subject to purchase limits. We may correct genuine errors in product information, pricing or availability. If an error materially affects an order that has been accepted, we will contact you and offer an appropriate solution, including cancellation and refund where applicable.
Orders, pricing and payment
Prices are displayed in Australian dollars and include GST unless stated otherwise. Delivery charges, where applicable, are shown at checkout before payment. We may offer payment methods or finance options through third-party providers. Their terms, eligibility criteria and approval decisions apply to those services.
Submitting an order is an offer to purchase. An order confirmation acknowledges that we have received your order; it does not necessarily mean that we have accepted it. We may need to review an order for stock availability, payment verification, delivery feasibility or suspected fraud. If we cannot accept an order before fulfilment, we will notify you and refund any amount paid for that order.
You must provide complete and accurate billing, delivery and contact information. You must be authorised to use the payment method supplied.
Ownership and risk. Ownership of products passes to you only when we have received payment in full, including any balance owing on a deposit or preorder. Risk of loss or damage passes to you on delivery or collection. If payment is not received in full, or a payment is reversed or charged back, we may contact you to arrange payment or the return of the products, subject to your rights under the Australian Consumer Law. Where your purchase is financed through a third-party provider, that provider's terms also apply.
Delivery and collection
Shipping charges, dispatch arrangements, estimated delivery times, transit insurance and collection arrangements are explained on our Shipping & Delivery page. Standard e-bike and e-trike shipping is free to VIC, NSW, QLD, SA and ACT; $250 AUD to WA and TAS; and $500 AUD to NT. Exceptional remote-area surcharges require customer agreement before dispatch. Parts and accessories orders over $100 AUD ship free, subject to the terms stated on that page.
Delivery estimates are not guarantees. You must provide a suitable delivery address and ensure that a person is available where a signature is required. Once an order has been dispatched, changes, redirects and cancellations may not be possible.
For shipped orders, transit insurance covers loss or damage while the order is being transported by Ridewave or its delivery partners. This does not cover transport arranged independently by the customer. If you arrange third-party transport for an assembled e-bike or e-trike, you do so at your own cost and risk.
Order cancellations, returns and refunds
If you need to cancel an order, contact us as soon as possible, ideally within 120 minutes of placing it. We aim to assist where the order has not entered fulfilment, but cannot guarantee cancellation once processing or dispatch has begun. Cancellation fees and preorder terms are set out in our Cancellation Policy.
Our voluntary change-of-mind return policy, fault remedies, battery-return requirements and refused-shipment fees are set out on our Returns & Refund Policy. That policy operates in addition to, and does not limit, your rights under the Australian Consumer Law.
Warranty and consumer guarantees
Ridewave provides a 2-year limited warranty on ebikes and e-trikes (battery: 2 years or 300 recharge cycles, whichever comes first) and a 6-month limited warranty on accessories, starting from the date of delivery or showroom pickup. The warranty is in addition to, and does not replace or limit, rights under the Australian Consumer Law. For warranty coverage, exclusions and claim instructions, please see our Warranty Terms.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a repair, replacement, refund or compensation depending on the nature of the issue. Please contact Ridewave first so we can assess the product and provide the appropriate remedy.
Safe use of e-bikes and e-trikes
You are responsible for using, maintaining, storing and charging your e-bike, e-trike and accessories safely and in accordance with the supplied instructions, product warnings and applicable laws. Before riding, check the brakes, tyres, controls, fasteners, lights and battery condition. Do not use a product if you believe it may be unsafe; contact us for support.
Road rules and e-bike requirements can vary between Australian states and territories. You are responsible for checking the rules that apply to your intended use, including requirements relating to helmets, rider conduct, power, throttle use, assisted speed and permitted riding areas.
Unauthorised modifications, unsafe use, improper assembly, overloading, water damage, neglect or failure to follow product instructions may affect warranty coverage and can create safety risks. These statements do not limit any rights that cannot lawfully be excluded.
Gift cards, promotions and discounts
Ridewave gift cards do not expire. They may be used only in accordance with the conditions displayed when they are issued and are not redeemable for cash except where required by law. Please treat gift cards as cash; we are not responsible for lost, stolen or misused gift cards except where required by law.
Promotions, discount codes and special offers are subject to their stated conditions, including any eligibility, expiry, product, quantity and combination restrictions. Unless stated otherwise, promotions cannot be applied retrospectively to completed orders or combined with other offers. We may withdraw or correct a promotion where there is a genuine error, subject to applicable law.
Unless stated otherwise, promotions and discount codes are for personal use by retail customers only. They may not be used by dealers, wholesalers or resellers, or for products purchased for resale. We may cancel and fully refund an order that uses a promotion in breach of its conditions.
SMS and email messages
If you opt in, we may send you marketing messages by SMS or email, including offers and cart reminders. Consent is not a condition of purchase. Message frequency varies, and your mobile provider's standard message and data charges may apply. You can opt out of marketing SMS at any time by replying STOP, and of marketing emails by using the unsubscribe link. We may still send service messages about your order, delivery, warranty or account. For more information, see our Privacy Policy.
Reviews, feedback and user content
If you submit a review, photograph, video, feedback or other content to us, you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person's rights. You grant Ridewave a non-exclusive, royalty-free licence to use, reproduce, publish and display that content for operating, promoting and improving our business, including on our website, social-media channels and marketing materials. You may ask us to stop using the content in future materials by contacting us; this will not affect material already published or distributed.
We may remove content that is unlawful, misleading, offensive, irrelevant or infringes another person's rights.
Intellectual property
Unless otherwise stated, the Ridewave name, logos, product content, photography, text, graphics, designs and website materials are owned by or licensed to Ridewave and are protected by intellectual-property laws. You may view and print them for personal, non-commercial use only. You must not copy, reproduce, modify, distribute or commercially use them without our prior written permission, except as permitted by law.
Third-party services and links
Our website may contain links to third-party websites or use third-party services such as payment, finance, review, delivery or social-media providers. Those providers operate under their own terms and privacy policies. Ridewave is not responsible for third-party websites, services or content, except to the extent required by law.
Liability
To the maximum extent permitted by law, Ridewave is not liable for indirect or consequential loss arising from use of the website or products. This does not exclude liability for consumer guarantees, personal injury, fraud, negligence or any other liability that cannot lawfully be excluded or limited.
Changes to these Terms
We may update these Terms from time to time. The current version will be published on this page with its effective date. Updated Terms apply to use of the website and orders placed after the effective date. Changes will not retrospectively alter the terms of an order already accepted, except where required by law or agreed with you.
Governing law
These Terms are governed by the laws of Victoria, Australia. Any dispute is subject to the courts of Victoria and any courts entitled to hear appeals from them, except where applicable law provides otherwise.
